Governing Documents

The order of precedence of the governing documents is: Florida Statutes, Declaration, By-Laws, and the Rules and Regulations. All residents of Forest Lake are subject to these laws and rules. Every person buying a unit in Forest Lake has all the rights of a property owner granted in common law but subject to restrictions in the Declaration of covenants at the time of purchase or as subsequently amended. Any changes to the explicit or inferable property rights granted to the purchasers of FLT units can only be changed by amending the Declaration. They cannot be changed by Board action alone. The Homeowners' Association (HOA) Board is permitted to make rules by Board motion regarding the use of the common property and facilities and has reasonable approval rights with respect to property leases. Rules promulgated by the Board regarding parcel use must be consistent with the rights granted by the Declaration and have certain notice requirements imposed by state law.

By-Laws

These are the By-Laws of the Forest Lake Townhomes Homeowners Association, Inc. This document is Section G of the Declaration. It is primarily concerned with Association membership, meetings, elections, the powers and duties of the five-member Board and its officers, and record keeping.

Declaration of Covenants

This is the primary governing document of the subdivision. It details the covenants, restrictions, and easements that each parcel or lot is subject to. It gives the Homeowners Association Board reasonable approval authority over leases and the ability to make and enforce Rules and Regulations pertaining to the common areas and facilities as long as they are not inconsistent with the Declaration.

Records Request

Members have the right to access all official records of the HOA. What constitutes the official records of an Association and the right to inspect and copy these records is found in FL Statute 720.303 (4-5). Official records include the governing documents, minutes of all meetings, a current roster of all members, their mailing addresses and parcel identifications, financial and accounting records, and all other written records related to the operation of the Association.
